Terms of Service
These terms apply to the use of the uncrsh app and website. They are written in plain language. Rights that mandatorily belong to you as a consumer always remain unaffected.
1. Provider and scope
The provider is [TODO: Name or company of the operator and media owner], [TODO: Address incl. country] (see the Legal notice). These terms govern the use of the uncrsh app (the “app”) and the related website. By registering, a user contract is formed between you and us.
2. Our service
uncrsh is a service for dating, friendship and community with a queer focus, open to everyone who takes part respectfully. You can create a profile, receive a small selection of profiles each day, like people and, when the interest is mutual, talk to a match. We owe you the provision of these functions, but not that you find matches, contacts or a relationship.
We keep developing the service and may change, add or remove functions if this is reasonable for you and the purpose of the service is preserved.
3. Minimum age, registration and account
- You must be at least 18 years old. We check this with your date of birth. Your details must be correct.
- You may have one account. It is not transferable. Your profile details must be true, and your photos must show you.
- You confirm your e-mail address with a code. Keep your password secret and tell us if you suspect your account is being misused. You can end all sessions in the app.
- The Privacy Policy describes how we process data: Privacy Policy.
4. Community rules and prohibited conduct
The community rules in the app are part of these terms. You confirm them at first start and again if we change them materially. In short:
- Respect every identity; no means no.
- No discrimination, insults, threats or harassment.
- No fake profiles, no borrowed photos, nobody under 18.
- Do not share screenshots, names or personal details of other people.
- No advertising, selling, spam or mass messages, and no links to outside sites for these purposes.
- No unlawful content, in particular no depictions of violence or sexual exploitation and nothing that infringes third-party rights.
- No attempts to disrupt or circumvent the service, to bypass security measures, to scrape data automatically or to use other people’s accounts.
Meet in a public place the first time and tell someone. We cannot guarantee that other users are truthful or follow the rules. A verification mark on a profile is not proof of identity or intentions.
5. Your content and rights of use
Your content (profile, photos, messages) stays yours. You grant us the simple, non-transferable right to store it for operating the service, to process it technically (for example to convert and resize photos) and to show it to other users as you set it up in the app. This right ends when the content or your account is deleted, unless we have to keep it for legal reasons.
You assure us that you hold the necessary rights to your content and that it does not infringe the rights of others, in particular that your photos do not show third parties without their consent.
6. Reports, moderation and measures
You can report profiles and individual messages in the app and block people. You can also send notices about unlawful content by e-mail to hallo@uncrsh.com, explaining why the content is unlawful and where you found it. New photos are checked before they are shown for the first time.
If content or conduct breaches the law, these terms or the community rules, we may, depending on severity, remove content, restrict visibility, warn, block functions, or suspend or terminate the account. We tell you about the measure and, where the law provides for it, the reasons, and explain how you can challenge it. You can send objections to hallo@uncrsh.com at any time; we review them promptly and not by automated means. Statutory remedies remain unaffected.
Users are responsible for the content they post. We are liable for it only under the statutory provisions, in particular only once we know of an infringement and then fail to act without delay.
7. Daily selection, dating city and dates
The daily selection is based on your details (for example who you want to see and who wants to see you), shared interests and goals and, if you allow it, the approximate distance. If you choose a dating city, you only see, and are only seen by, people with the same city. If you look for dating you can choose “something casual” or “something serious”; you then only see those of the people looking for dating who made the same choice. Please state truthfully what you are looking for. More details are in the Privacy Policy. You can change your details at any time and hide your profile.
Within a match you can keep private notes about your dates and, after the first date, answer the question “More dates?”. These functions are voluntary and help both people align expectations honestly. They do not replace a conversation and give no claim to further dates. Answer honestly and respect the other person’s answer; a “not for me” is never shown to anyone on its own, and nobody may pressure others to reveal their answer.
8. Costs
Using the app is currently free of charge. If we introduce paid features, we will first inform you clearly about price, service, term, cancellation and your right of withdrawal, and conclude such contracts only with your explicit consent. Existing free access does not automatically become paid.
9. Availability
We strive for trouble-free operation but cannot promise uninterrupted availability. Maintenance, updates and disruptions beyond our control can cause outages. We announce planned longer interruptions where possible.
10. Term, termination and deletion
The contract runs for an indefinite period. You can delete your account in the app at any time. Deletion becomes permanent after a 14-day grace period. We may terminate the contract with immediate effect for good cause at any time, in particular for serious or repeated breaches of section 4. Otherwise we terminate it with reasonable notice and let you know.
11. Liability
We are liable under the statutory provisions. Mandatory statutory liability, in particular for intent, gross negligence, personal injury and under the Product Liability Act, is neither excluded nor limited. We are not responsible for the conduct of other users, as far as the law allows.
12. Changes to these terms
We may change these terms, for example when the service or the law changes. Changes that materially affect you will be communicated in the app or by e-mail; they only apply to you once you agree to them (for example the next time you open the app). If you do not agree, you cannot keep using the service and can delete your account. Pure clarifications and legally required adjustments that do not put you at a disadvantage can be made without your consent.
13. Governing law, jurisdiction and complaints
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the state where you have your habitual residence and the statutory places of jurisdiction remain unaffected.
For questions, complaints and concerns write to us at hallo@uncrsh.com. We want to solve problems together.
14. Final provisions
If a provision is invalid, the rest remains effective; the statutory rule replaces the invalid provision. These terms exist in German and English; in case of differences, the German version prevails as far as legally permissible.
